Code, Commercial Law § 15–804","heading":"","body":"(a) Notwithstanding any other provisions of this article, §§ 15-802 and 15-803 of this subtitle do not apply to any check:\n(1) Tendered by a maker or drawer in complete or partial satisfaction of a preexisting credit or loan obligation incurred by the maker or drawer under Title 12 of this article; or\n(2) That is not a bad check as described under § 8-103 of the Criminal Law Article.\n(b) Notwithstanding any other provision of this article, §§ 15-802 and 15-803 of this subtitle shall be construed to grant any holder to whom the check or other instrument was issued or negotiated a right of recourse which is alternative to any other right of recourse granted to that holder under Title 3 of this article.","path":["Article - Commercial Law"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gcl\u0026section=15-804","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:56:33Z","sha256":"9ddfc1f95f4429233a7d357aed2a10acb4e19935bb36e198b7f670603a7ad262","source_id":"us-md","stale":false,"prev":"us-md/md.-code-commercial-law-15-803","next":"us-md/md.-code-commercial-law-16-101"},"notice":"GroundRules: Original legal text.
