Code, Commercial Law § 2–326","heading":"","body":"(1) Unless otherwise agreed, if delivered goods may be returned by the buyer even though they conform to the contract, the transaction is\n(a) A “sale on approval” if the goods are delivered primarily for use, and\n(b) A “sale or return” if the goods are delivered primarily for resale.\n(2) Goods held on approval are not subject to the claims of the buyer’s creditors until acceptance; goods held on sale or return are subject to such claims while in the buyer’s possession.\n(3) Any “or return” term of a contract for sale is to be treated as a separate contract for sale within the statute of frauds section of this title (§ 2-201) and as contradicting the sale aspect of the contract within the provisions of this title on parole or extrinsic evidence (§ 2-202).","path":["Article - Commercial Law"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gcl\u0026section=2-326","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:56:33Z","sha256":"9130eeb4c07f406130ee72a463fe5a14cb1ffec1e2153816cbc8727866a9cb21","source_id":"us-md","stale":false,"prev":"us-md/md.-code-commercial-law-2-325","next":"us-md/md.-code-commercial-law-2-327"},"notice":"GroundRules: Original legal text.
