Code, Commercial Law § 22–404","heading":"","body":"(a) Unless the warranty is disclaimed or modified, a merchant that, in a special relationship of reliance with a licensee, collects, compiles, processes, provides, or transmits informational content warrants to that licensee that there is no inaccuracy in the informational content caused by the merchant’s failure to perform with reasonable care.\n(b) A warranty does not arise under subsection (a) of this section with respect to:\n(1) Published informational content; or\n(2) A person that acts as a conduit or provides no more than editorial services in collecting, compiling, distributing, processing, providing, or transmitting informational content that under the circumstances can be identified as that of a third person.\n(c) The warranty under this section is not subject to the preclusion in § 22-113(a)(1) of this title on disclaiming obligations of diligence, reasonableness, or care.","path":["Article - Commercial Law"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gcl\u0026section=22-404","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:56:33Z","sha256":"a330f643617e3adab915e46846a1430a4ff3e62f1bfe7d6fe4a19117bcc047c7","source_id":"us-md","stale":false,"prev":"us-md/md.-code-commercial-law-22-403","next":"us-md/md.-code-commercial-law-22-405"},"notice":"GroundRules: Original legal text.
