Code, Commercial Law § 9–325","heading":"","body":"(a) Except as otherwise provided in subsection (b), a security interest created by a debtor is subordinate to a security interest in the same collateral created by another person if:\n(1) The debtor acquired the collateral subject to the security interest created by the other person;\n(2) The security interest created by the other person was perfected when the debtor acquired the collateral; and\n(3) There is no period thereafter when the security interest is unperfected.\n(b) Subsection (a) subordinates a security interest only if the security interest:\n(1) Otherwise would have priority solely under § 9-322(a) or § 9-324; or\n(2) Arose solely under § 2-711(3) or § 2A-508(5) of this article.","path":["Article - Commercial Law"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gcl\u0026section=9-325","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:56:33Z","sha256":"7d37a7a04ba30f0734f8a77c33ec252eba14e5ed328d0e7db6149e158b9926a1","source_id":"us-md","stale":false,"prev":"us-md/md.-code-commercial-law-9-324","next":"us-md/md.-code-commercial-law-9-326"},"notice":"GroundRules: Original legal text.
