Code, Commercial Law § 9–333","heading":"","body":"(a) In this section, “possessory lien” means an interest, other than a security interest or an agricultural lien:\n(1) Which secures payment or performance of an obligation for services or materials furnished with respect to goods by a person in the ordinary course of the person’s business;\n(2) Which is created by statute or rule of law in favor of the person; and\n(3) Whose effectiveness depends on the person’s possession of the goods.\n(b) A possessory lien on goods has priority over a security interest in the goods unless the lien is created by a statute that expressly provides otherwise.","path":["Article - Commercial Law"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gcl\u0026section=9-333","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:56:33Z","sha256":"938264b7bf993bc79801e7dfe4664d3cfeac7f5450c58d974af38c40402336e3","source_id":"us-md","stale":false,"prev":"us-md/md.-code-commercial-law-9-332","next":"us-md/md.-code-commercial-law-9-334"},"notice":"GroundRules: Original legal text.
