Code, Corporations and Associations § 5–636","heading":"","body":"(a) Subject to subsection (b) of this section, within 180 days after providing a certification to the Commission under § 5–635(h) of this subtitle, the cooperative’s board of directors, by a supermajority vote, shall:\n(1) Adopt bylaws for the member–regulated cooperative; and\n(2) Amend the cooperative’s articles of incorporation to reflect the cooperative’s conversion to being a member–regulated cooperative.\n(b) The bylaws and amended articles of incorporation shall:\n(1) Authorize the member–regulated cooperative to provide broadband Internet service;\n(2) Establish a plan for making broadband Internet service available to members in a manner that maximizes deployment with available financial resources;\n(3) Include an allocation method in accordance with § 5–607(c) of this subtitle to ensure that electric customers do not subsidize the cost of broadband Internet service; and\n(4) Except as provided in § 5–637(a)(2) of this subtitle, be consistent with this subtitle.","path":["Article - Corporations and Associations"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gca\u0026section=5-636","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:56:43Z","sha256":"6f603eff0566004789c4ae958df9840bc765353d28f1255d4ce8e270484aff85","source_id":"us-md","stale":false,"prev":"us-md/md.-code-corporations-and-associations-5-635","next":"us-md/md.-code-corporations-and-associations-5-637"},"notice":"GroundRules: Original legal text.
