Code, Correctional Services § 11–316","heading":"","body":"(a) Except as provided in subsection (c) of this section, the Commissioner may place an incarcerated individual in a center if the incarcerated individual:\n(1) is a resident of:\n(i) the county in which the center is located; or\n(ii) for a regional center, one of the counties in the region;\n(2) has:\n(i) less than 6 months remaining on a sentence;\n(ii) less than 6 months remaining until a determined parole date; or\n(iii) a sentence of 3 years or less; and\n(3) has been screened by a center staff member and approved by the center director as provided under subsection (b) of this section.\n(b) (1) A center staff member shall screen an incarcerated individual for placement in a center.\n(2) After a review of the screening data, the center director may approve a placement based on screening standards that are established by the community advisory board, the center director, and the Commissioner.\n(3) The screening standards shall include a presentence investigation report if available and a complete record of previous convictions.\n(c) (1) This subsection applies only to Cecil County.\n(2) The Commissioner may place an incarcerated individual in a center operated by Cecil County if the incarcerated individual:\n(i) has been committed by the court to the custody of the Commissioner;\n(ii) is a legal resident of Cecil County;\n(iii) has:\n1. less than 6 months remaining on a sentence;\n2. less than 6 months remaining until a determined parole date; or\n3. a sentence of 3 years or less; and\n(iv) has been screened by a center staff member and approved by the center director in accordance with subsection (b) of this section.\n(3) The court may recommend that an incarcerated individual be placed in a center.","path":["Article - Correctional Services"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gcs\u0026section=11-316","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:56:53Z","sha256":"03510e25f728056269c3462cbc75b61afd878e267834f3af2306f01861edd7ff","source_id":"us-md","stale":false,"prev":"us-md/md.-code-correctional-services-11-315","next":"us-md/md.-code-correctional-services-11-317"},"notice":"GroundRules: Original legal text.
