Code, Correctional Services § 2–118","heading":"","body":"(a) This section applies to incarcerated individuals in a State correctional facility.\n(b) (1) Except as provided in paragraph (2) of this subsection, the Secretary shall assess a reasonable fee not to exceed $4 for each visit by an incarcerated individual to a medical unit, physician, dentist, or optometrist for health care services.\n(2) The Secretary may not assess a fee for health care services that are:\n(i) required as a part of the intake process;\n(ii) required for an initial physical examination;\n(iii) due to a referral by a nurse or physician’s assistant;\n(iv) provided during a follow–up visit that is initiated by a medical professional from the correctional facility;\n(v) required for necessary treatment; or\n(vi) initiated by a medical or mental health staff member of the correctional facility.\n(c) The Secretary shall adopt regulations to implement and collect the fees required by this section.","path":["Article - Correctional Services"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gcs\u0026section=2-118","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:56:53Z","sha256":"3cfe02b660ec798238cc4787c23a5d540114a47820dfcbead90dc918f9a7b77f","source_id":"us-md","stale":false,"prev":"us-md/md.-code-correctional-services-2-117","next":"us-md/md.-code-correctional-services-2-201"},"notice":"GroundRules: Original legal text.
