Code, Correctional Services § 3–409","heading":"","body":"(a) (1) An incarcerated individual who willfully violates the conditions of the incarcerated individual’s placement in the program is guilty of a misdemeanor and on conviction is subject to imprisonment not exceeding 1 year.\n(2) Notwithstanding § 9–104 of this article, a sentence under this subsection may be to the jurisdiction of the Division.\n(b) Commission of any crime by an incarcerated individual constitutes a violation of the conditions of the incarcerated individual’s placement in the program.\n(c) An incarcerated individual who knowingly violates § 3–406 of this subtitle is guilty of escape and on conviction is subject to the penalties of § 9–404 of the Criminal Law Article.","path":["Article - Correctional Services"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gcs\u0026section=3-409","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:56:53Z","sha256":"efe0a8721612d2d036afb23a11b492d198a98e053960b8e590a63b431f8767e0","source_id":"us-md","stale":false,"prev":"us-md/md.-code-correctional-services-3-408","next":"us-md/md.-code-correctional-services-3-410"},"notice":"GroundRules: Original legal text.
