Code, Courts and Judicial Proceedings § 10–312","heading":"","body":"(a) Subject to subsection (b) of this section, in a prosecution for a diesel emissions standard violation under Title 23, Subtitle 4 of the Transportation Article, emissions test results from emissions test equipment as described in § 23-402 of the Transportation Article are admissible at trial in any court with jurisdiction over the proceeding in the State.\n(b) If at the time of testing, a diesel vehicle fails to meet the emissions standard established under Title 23, Subtitle 4 of the Transportation Article, the failure to meet the established emissions standard shall be prima facie evidence that the operator of the diesel vehicle violated the provisions of Title 23, Subtitle 4 of the Transportation Article.","path":["Article - Courts and Judicial Proceedings"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gcj\u0026section=10-312","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:57:03Z","sha256":"66df6c55c209c4756fa7c513cb448ba847dc49732bc864fe2f8203941d27ec9e","source_id":"us-md","stale":false,"prev":"us-md/md.-code-courts-and-judicial-proceedings-10-311","next":"us-md/md.-code-courts-and-judicial-proceedings-10-401"},"notice":"GroundRules: Original legal text.
