Code, Courts and Judicial Proceedings § 3–1803","heading":"","body":"(a) Except as provided in § 3–1804 of this subtitle, a mediator or any person present or otherwise participating in a mediation at the request of a mediator:\n(1) Shall maintain the confidentiality of all mediation communications; and\n(2) May not disclose or be compelled to disclose mediation communications in any judicial, administrative, or other proceeding.\n(b) Except as provided in § 3–1804 of this subtitle:\n(1) A party to a mediation and any person present or otherwise participating in the mediation at the request of a party may not disclose or be compelled to disclose mediation communications in any judicial, administrative, or other proceeding; and\n(2) The parties may enter into a written agreement to maintain the confidentiality of all mediation communications and may require any person present or otherwise participating in the mediation at the request of a party to maintain the confidentiality of all mediation communications.","path":["Article - Courts and Judicial Proceedings"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gcj\u0026section=3-1803","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:57:03Z","sha256":"0a0a8514c878f0b6be3cad6e3930bee35b7d269531261151249274ca96471f96","source_id":"us-md","stale":false,"prev":"us-md/md.-code-courts-and-judicial-proceedings-3-1802","next":"us-md/md.-code-courts-and-judicial-proceedings-3-1804"},"notice":"GroundRules: Original legal text.
