Code, Courts and Judicial Proceedings § 3–2012","heading":"","body":"(a) Notwithstanding the failure of an agreement to meet the requirements of § 3–2002 of this subtitle, a tribunal may find that the parties intended to enter into a collaborative law participation agreement if the parties:\n(1) Signed a record indicating an intention to enter into a collaborative law participation agreement; and\n(2) Reasonably believed they were participating in a collaborative law process.\n(b) If a tribunal makes the findings specified in subsection (a) of this section and the interests of justice require, the tribunal may:\n(1) Enforce an agreement evidenced by a record resulting from the process in which the parties participated; and\n(2) Apply the privileges under § 3–2009 of this subtitle.","path":["Article - Courts and Judicial Proceedings"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gcj\u0026section=3-2012","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:57:03Z","sha256":"03d3293d72eeceef60d196a17a980a0226c8eb9f45ce44c0175772ec36a1d28d","source_id":"us-md","stale":false,"prev":"us-md/md.-code-courts-and-judicial-proceedings-3-2011","next":"us-md/md.-code-courts-and-judicial-proceedings-3-2013"},"notice":"GroundRules: Original legal text.
