Code, Courts and Judicial Proceedings § 3–8A–14.1","heading":"","body":"(a) After an inquiry conducted in accordance with § 3–8A–10 of this subtitle, an intake officer may file with the court an application for an arrest warrant prepared by a law enforcement officer.\n(b) An application for an arrest warrant under this section shall be:\n(1) In writing;\n(2) Signed and sworn to by the law enforcement officer; and\n(3) Accompanied by an affidavit that sets forth the basis for there being probable cause to believe that:\n(i) The child who is the subject of the warrant has committed a delinquent act; and\n(ii) Unless the child who is the subject of the warrant is taken into custody, the child:\n1. Is likely to leave the jurisdiction of the court;\n2. May not be apprehended;\n3. May cause physical injury or property damage to another; or\n4. May tamper with, dispose of, or destroy evidence.\n(c) An arrest warrant requested under subsection (a) of this section may only be issued by the court on a finding of probable cause and shall direct the law enforcement officer to take immediate custody of the child.","path":["Article - Courts and Judicial Proceedings"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gcj\u0026section=3-8A-14.1","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:57:03Z","sha256":"9115fe7d83aafc39e8d0a6089e54f131cd9c12b719dc2f782b478ff308cf9b4b","source_id":"us-md","stale":false,"prev":"us-md/md.-code-courts-and-judicial-proceedings-3-8a-14","next":"us-md/md.-code-courts-and-judicial-proceedings-3-8a-14.2"},"notice":"GroundRules: Original legal text.
