Code, Courts and Judicial Proceedings § 5–121","heading":"","body":"(a) (1) In this section the following words have the meaning indicated.\n(2) “Homeowner” means:\n(i) A record owner of residential property that is owner–occupied at the time the alleged violation of § 13–301 of the Commercial Law Article or other State law occurred; or\n(ii) An individual who occupies residential property under a use and possession order issued under Title 8, Subtitle 2 of the Family Law Article.\n(3) “Mortgage servicer” has the meaning stated in § 11–501 of the Financial Institutions Article.\n(4) “Residential property” has the meaning stated in § 7–105.1 of the Real Property Article.\n(5) “Unfair, abusive, or deceptive trade practice” has the meaning stated in § 13–301 of the Commercial Law Article.\n(b) This section applies only to claims relating to residential property.\n(c) An action filed by a homeowner against a mortgage servicer for damages arising out of an unfair, abusive, or deceptive trade practice shall be filed within the earlier of:\n(1) 5 years after a foreclosure sale of the residential property; or\n(2) If the mortgage servicer discloses its unfair, abusive, or deceptive trade practice to the homeowner, 3 years after the disclosure to the homeowner.","path":["Article - Courts and Judicial Proceedings"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gcj\u0026section=5-121","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:57:03Z","sha256":"dabcec33477e15b2ecb0b311a86afe7228c4df0d17bde2a6fe4533cf44368676","source_id":"us-md","stale":false,"prev":"us-md/md.-code-courts-and-judicial-proceedings-5-120","next":"us-md/md.-code-courts-and-judicial-proceedings-5-201"},"notice":"GroundRules: Original legal text.
