Code, Courts and Judicial Proceedings § 5–617","heading":"","body":"(a) In this section, “discharge” includes leakage, seepage, or other release of a hazardous substance or material.\n(b) Except as provided in subsections (c) and (d) of this section, a person who is called on for assistance in an emergency is not subject to any civil liability or penalty as a result of assistance or advice rendered in:\n(1) Mitigating the effects of an actual or threatened discharge of a hazardous substance or material;\n(2) Preventing a discharge of a hazardous substance or material;\n(3) Cleaning up a discharge of a hazardous substance or material; or\n(4) Attempting any of the acts in this subsection.\n(c) The immunity provided in subsection (b) of this section does not apply to a person:\n(1) Whose act or omission was the original cause of an actual or threatened discharge in whole or in part, and who would otherwise be liable for the act or omission; or\n(2) Who received compensation other than reimbursement for out-of-pocket expenses for rendering the assistance or advice.\n(d) Notwithstanding subsection (b) of this section, a person is liable for damages caused by that person’s gross negligence or reckless, wanton, or intentional misconduct.","path":["Article - Courts and Judicial Proceedings"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gcj\u0026section=5-617","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:57:03Z","sha256":"e65174c55fc9e731ae2ddc1442ba3c79e41d0ec1623643676e119e0fe8e5aac9","source_id":"us-md","stale":false,"prev":"us-md/md.-code-courts-and-judicial-proceedings-5-615","next":"us-md/md.-code-courts-and-judicial-proceedings-5-618"},"notice":"GroundRules: Original legal text.
