Code, Courts and Judicial Proceedings § 5–804","heading":"","body":"(a) (1) In this section the following words have the meanings indicated.\n(2) “Cave” has the meaning stated in § 5-1401 of the Natural Resources Article.\n(3) “Commercial cave” has the meaning stated in § 5-1401 of the Natural Resources Article.\n(4) “Owner” has the meaning stated in § 5-1401 of the Natural Resources Article.\n(5) “Person” has the meaning stated in § 5-1401 of the Natural Resources Article.\n(b) An owner of a cave or the owner’s authorized agents acting within the scope of their authority are not liable for injuries sustained by any person using the cave for a recreational or scientific purpose if the prior consent of the owner has been obtained and if no charge has been made for the use of the cave.\n(c) An owner of a commercial cave is not liable for an injury sustained by a spectator who has paid to view the cave unless:\n(1) The injury is sustained as a result of the owner’s negligence in connection with the providing and maintaining of trails, stairs, electrical wires, or other modifications; and\n(2) The negligence is the proximate cause of the injury.","path":["Article - Courts and Judicial Proceedings"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gcj\u0026section=5-804","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:57:03Z","sha256":"263272c20c594071de9df7a3526d7fece38bec7a4d194c36955a61263b4851c1","source_id":"us-md","stale":false,"prev":"us-md/md.-code-courts-and-judicial-proceedings-5-803","next":"us-md/md.-code-courts-and-judicial-proceedings-5-805"},"notice":"GroundRules: Original legal text.
