Code, Criminal Law § 10–121","heading":"","body":"(a) This section does not apply to a person who:\n(1) was acting in the capacity of a licensee, or an employee of a licensee, under the Alcoholic Beverages and Cannabis Article; and\n(2) has committed a violation of and is subject to the penalties under § 6–304, § 6–307, § 6–308, or § 6–309 of the Alcoholic Beverages and Cannabis Article.\n(b) Except as provided in subsection (c) of this section, an adult who violates § 10–116 or § 10–117 of this subtitle is guilty of a misdemeanor and on conviction is subject to:\n(1) a fine not exceeding $2,500 for a first offense; or\n(2) a fine not exceeding $5,000 for a second or subsequent offense.\n(c) An adult who violates § 10–117(d) of this subtitle is guilty of a misdemeanor and on conviction is subject to imprisonment not exceeding 1 year or a fine not exceeding $5,000 or both.","path":["Article - Criminal Law"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gcr\u0026section=10-121","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:57:08Z","sha256":"ffa11082b0a4ddb2ce1c331f30e91e587732bd106afb463eb88ca4123d05aedb","source_id":"us-md","stale":false,"prev":"us-md/md.-code-criminal-law-10-120","next":"us-md/md.-code-criminal-law-10-123"},"notice":"GroundRules: Original legal text.
