Code, Criminal Law § 10–131","heading":"","body":"(a) A person may not distribute Salvia divinorum to an individual under the age of 21 years.\n(b) In a prosecution for a violation of this section, it is a defense that the defendant examined the purchaser’s or recipient’s driver’s license or other valid identification issued by an employer, a government unit, or an institution of higher education that positively identified the purchaser or recipient as at least 21 years of age.\n(c) A person who violates this section is guilty of a misdemeanor and on conviction is subject to a fine not exceeding:\n(1) $1,000 for a first violation;\n(2) $2,000 for a second violation occurring within 2 years after the first violation; and\n(3) $6,000 for each subsequent violation occurring within 2 years after the preceding violation.\n(d) For purposes of this section, each separate incident at a different time and occasion is a separate violation.","path":["Article - Criminal Law"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gcr\u0026section=10-131","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:57:08Z","sha256":"39859ab65861e1a40a2d4799c238e0461bfdb0fdf1716a535b73feda2b36cef2","source_id":"us-md","stale":false,"prev":"us-md/md.-code-criminal-law-10-130","next":"us-md/md.-code-criminal-law-10-132"},"notice":"GroundRules: Original legal text.
