Code, Criminal Law § 10–502","heading":"","body":"(a) This section does not apply to a person if:\n(1) the person’s previous lawful spouse has been absent from the person for a continuous period of 7 years; and\n(2) the person does not know whether the person’s previous lawful spouse is living at the time of the subsequent marriage ceremony.\n(b) While lawfully married to a living person, a person may not enter into a marriage ceremony with another.\n(c) A person who violates this section is guilty of the felony of bigamy and on conviction is subject to imprisonment not exceeding 9 years.\n(d) An indictment or warrant for bigamy is sufficient if it substantially states:\n“(name of defendant) on (date), in (county), having a living spouse, feloniously entered into a marriage ceremony with (name of subsequent spouse), in violation of § 10-502 of the Criminal Law Article, against the peace, government, and dignity of the State.”.","path":["Article - Criminal Law"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gcr\u0026section=10-502","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:57:08Z","sha256":"f1be4bedbd831badcacc57fb7278fef36f2ed1f62e2d398e4149cb6ca892a7fa","source_id":"us-md","stale":false,"prev":"us-md/md.-code-criminal-law-10-501","next":"us-md/md.-code-criminal-law-10-601"},"notice":"GroundRules: Original legal text.
