Code, Criminal Law § 11–206","heading":"","body":"(a) (1) A person may not knowingly require a purchaser or consignee to receive obscene matter as a condition to a sale, allocation, consignment, or delivery for resale of a paper, magazine, book, periodical, publication, or other merchandise.\n(2) In response to a person’s return of or failure to accept obscene matter, a person may not knowingly:\n(i) deny or revoke a franchise;\n(ii) threaten to deny or revoke a franchise; or\n(iii) impose a financial or other penalty.\n(b) A person who violates this section is guilty of a misdemeanor and on conviction is subject to:\n(1) for a first violation, imprisonment not exceeding 1 year or a fine not exceeding $1,000 or both; and\n(2) for each subsequent violation, imprisonment not exceeding 3 years or a fine not exceeding $5,000 or both.","path":["Article - Criminal Law"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gcr\u0026section=11-206","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:57:08Z","sha256":"9f446033049be5ffca66a5ffb0703cf1544655268e3e7cb1064a511f62946f39","source_id":"us-md","stale":false,"prev":"us-md/md.-code-criminal-law-11-205","next":"us-md/md.-code-criminal-law-11-207"},"notice":"GroundRules: Original legal text.
