Code, Criminal Law § 3–204","heading":"","body":"(a) A person may not recklessly:\n(1) engage in conduct that creates a substantial risk of death or serious physical injury to another; or\n(2) discharge a firearm from a motor vehicle in a manner that creates a substantial risk of death or serious physical injury to another.\n(b) A person who violates this section is guilty of the misdemeanor of reckless endangerment and on conviction is subject to imprisonment not exceeding 5 years or a fine not exceeding $5,000 or both.\n(c) (1) Subsection (a)(1) of this section does not apply to conduct involving:\n(i) the use of a motor vehicle, as defined in § 11-135 of the Transportation Article; or\n(ii) the manufacture, production, or sale of a product or commodity.\n(2) Subsection (a)(2) of this section does not apply to:\n(i) a law enforcement officer or security guard in the performance of an official duty; or\n(ii) an individual acting in defense of a crime of violence as defined in § 5-101 of the Public Safety Article.","path":["Article - Criminal Law"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gcr\u0026section=3-204","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:57:08Z","sha256":"6721b902e46f4ceacdbb684844d00b86748c2a0f528b3b362ec9840dad3a0ed8","source_id":"us-md","stale":false,"prev":"us-md/md.-code-criminal-law-3-203","next":"us-md/md.-code-criminal-law-3-205"},"notice":"GroundRules: Original legal text.
