Code, Criminal Law § 3–401","heading":"","body":"(a) In this subtitle the following words have the meanings indicated.\n(b) “Deprive” means to withhold property of another:\n(1) permanently;\n(2) for a period that results in the appropriation of a part of the property’s value;\n(3) with the purpose to restore it only on payment of a reward or other compensation; or\n(4) to dispose of the property or use or deal with the property in a manner that makes it unlikely that the owner will recover it.\n(c) “Obtain” means:\n(1) in relation to property, to bring about a transfer of interest in or possession of the property; and\n(2) in relation to a service, to secure the performance of the service.\n(d) (1) “Property” means anything of value.\n(2) “Property” includes:\n(i) real estate;\n(ii) money;\n(iii) a commercial instrument;\n(iv) an admission or transportation ticket;\n(v) a written instrument representing or embodying rights concerning anything of value, or services, or anything otherwise of value to the owner;\n(vi) a thing growing on, affixed to, or found on land, or that is part of or affixed to any building;\n(vii) electricity, gas, and water;\n(viii) a bird, animal, or fish that ordinarily is kept in a state of confinement;\n(ix) food or drink;\n(x) a sample, culture, microorganism, or specimen;\n(xi) a record, recording, document, blueprint, drawing, map, or a whole or partial copy, description, photograph, prototype, or model of any of them;\n(xii) an article, material, device, substance, or a whole or partial copy, description, photograph, prototype, or model of any of them that represents evidence of, reflects, or records a secret:\n1. scientific, technical, merchandising, production, or management information; or\n2. designed process, procedure, formula, invention, trade secret, or improvement;\n(xiii) a financial instrument; and\n(xiv) information, electronically produced data, and a computer software or program in a form readable by machine or individual.\n(e) “Robbery” retains its judicially determined meaning except that:\n(1) robbery includes obtaining the service of another by force or threat of force; and\n(2) robbery requires proof of intent to withhold property of another:\n(i) permanently;\n(ii) for a period that results in the appropriation of a part of the property’s value;\n(iii) with the purpose to restore it only on payment of a reward or other compensation; or\n(iv) to dispose of the property or use or deal with the property in a manner that makes it unlikely that the owner will recover it.\n(f) “Service” includes:\n(1) labor or professional service;\n(2) telecommunication, public utility, toll facility, or transportation service;\n(3) lodging, entertainment, or restaurant service; and\n(4) the use of computers, data processing, or other equipment.","path":["Article - Criminal Law"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gcr\u0026section=3-401","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:57:08Z","sha256":"f2a3359d2773a0f7e1c7fb7ba02202bf9d915816bb55a9ed31babacf877eece0","source_id":"us-md","stale":false,"prev":"us-md/md.-code-criminal-law-3-325","next":"us-md/md.-code-criminal-law-3-402"},"notice":"GroundRules: Original legal text.
