Code, Criminal Law § 3–405","heading":"","body":"(a) In this section, “motor vehicle” has the meaning stated in § 11-135 of the Transportation Article.\n(b) (1) An individual may not take unauthorized possession or control of a motor vehicle from another individual who actually possesses the motor vehicle, by force or violence, or by putting that individual in fear through intimidation or threat of force or violence.\n(2) A violation of this subsection is carjacking.\n(c) (1) A person may not employ or display a dangerous weapon during the commission of a carjacking.\n(2) A violation of this subsection is armed carjacking.\n(d) A person who violates this section is guilty of a felony and on conviction is subject to imprisonment not exceeding 30 years.\n(e) A sentence imposed under this section may be separate from and consecutive to a sentence for any other crime that arises from the conduct underlying the carjacking or armed carjacking.\n(f) It is not a defense under this section that the defendant did not intend to permanently deprive the owner or possessor of the motor vehicle.","path":["Article - Criminal Law"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gcr\u0026section=3-405","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:57:08Z","sha256":"98b943362225a2d12e41de3379137279e0f1fa2a27a0314fe7750e8ca2f644c2","source_id":"us-md","stale":false,"prev":"us-md/md.-code-criminal-law-3-404","next":"us-md/md.-code-criminal-law-3-501"},"notice":"GroundRules: Original legal text.
