Code, Criminal Law § 5–103","heading":"","body":"(a) (1) Subject to paragraph (2) of this subsection, this title does not apply to the sale of a prescription drug:\n(i) made to an authorized provider; or\n(ii) made by a manufacturer, wholesale distributor, or pharmacist licensed by the State to:\n1. another manufacturer, wholesale distributor, or pharmacist licensed by the State; or\n2. a hospital or institution that operates a dispensary in which an authorized provider licensed to administer prescription drugs is in charge.\n(2) A sale is exempt from this title only if a record of the sale:\n(i) is maintained and available for inspection; and\n(ii) shows the date of sale, the name and address of the purchaser, and the quantity purchased.\n(b) This title does not apply to:\n(1) the distribution of a prescription drug, device, or supply for the treatment, care, or cure of farm animals, poultry, fowl, or other animals used in furtherance of farming activities;\n(2) the sale or offering for sale, or the distribution of seeds, feed for livestock and poultry, fertilizers, lime, land plaster, fungicides, and insecticides; or\n(3) a drug that on June 1, 1961, could be sold without a prescription.","path":["Article - Criminal Law"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gcr\u0026section=5-103","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:57:08Z","sha256":"cee3075641ad547ab76da208a2e4cfed0a2a46a2b97edc59ca30a98633754f68","source_id":"us-md","stale":false,"prev":"us-md/md.-code-criminal-law-5-102","next":"us-md/md.-code-criminal-law-5-201"},"notice":"GroundRules: Original legal text.
