Code, Criminal Law § 5–403","heading":"","body":"(a) Schedule II consists of each controlled dangerous substance:\n(1) added to Schedule II by the Department under § 5–202(b) of this title; or\n(2) designated as a Schedule II controlled dangerous substance by the federal government unless the Department objects under § 5–202(f) of this title.\n(b) The Department may not add a substance to Schedule II under § 5–202 of this title unless the Department finds:\n(1) a high potential for abuse of the substance;\n(2) currently accepted medical use of the substance in the United States, or currently accepted medical use with severe restrictions; and\n(3) evidence that abuse of the substance may lead to severe psychological or physical dependence.","path":["Article - Criminal Law"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gcr\u0026section=5-403","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:57:08Z","sha256":"aa1851b7c68b474f7afab2c8d5356afc07f1b060288a93e4710f2875b27085b7","source_id":"us-md","stale":false,"prev":"us-md/md.-code-criminal-law-5-402","next":"us-md/md.-code-criminal-law-5-404"},"notice":"GroundRules: Original legal text.
