Code, Criminal Law § 5–404","heading":"","body":"(a) Schedule III consists of each controlled dangerous substance by whatever official name, common or usual name, chemical name, or brand name:\n(1) added to Schedule III by the Department under § 5–202(b) of this title; or\n(2) designated as a Schedule III controlled dangerous substance by the federal government unless the Department objects under § 5–202(f) of this title.\n(b) The Department may not add a substance to Schedule III under § 5–202 of this title unless the Department finds:\n(1) a potential for abuse of the substance that is less than that for the substances listed in Schedule I and Schedule II;\n(2) well documented and approved medical use of the substance in the United States; and\n(3) evidence that abuse of the substance may lead to moderate or low physical dependence or high psychological dependence.","path":["Article - Criminal Law"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gcr\u0026section=5-404","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:57:08Z","sha256":"9d340211efe6cf54aa35fb25ba94d60f82e34d4b23f56ee58b51471add7f5aa9","source_id":"us-md","stale":false,"prev":"us-md/md.-code-criminal-law-5-403","next":"us-md/md.-code-criminal-law-5-405"},"notice":"GroundRules: Original legal text.
