Code, Criminal Law § 5–405","heading":"","body":"(a) Schedule IV consists of each controlled dangerous substance:\n(1) added to Schedule IV by the Department under § 5–202(b) of this title; or\n(2) designated as a Schedule IV controlled dangerous substance by the federal government unless the Department objects under § 5–202(f) of this title.\n(b) The Department may not add a substance to Schedule IV under § 5–202 of this title unless the Department finds that:\n(1) the substance has a low potential for abuse relative to the substances listed in Schedule III;\n(2) the substance has currently accepted medical use in treatment in the United States; and\n(3) abuse of the substance may lead to limited physical dependence or psychological dependence relative to the substances in Schedule III.","path":["Article - Criminal Law"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gcr\u0026section=5-405","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:57:08Z","sha256":"9cffea85a36126a0e96b102f6f0174bb4fc9ed931b3f47b735d90f8054b37b1f","source_id":"us-md","stale":false,"prev":"us-md/md.-code-criminal-law-5-404","next":"us-md/md.-code-criminal-law-5-406"},"notice":"GroundRules: Original legal text.
