Code, Criminal Law § 5–709","heading":"","body":"(a) In this section, “distribute” includes actual, constructive, or attempted transfer, exchange, or delivery, regardless of remuneration or agency relationship.\n(b) A person may not distribute or possess with intent to distribute to another a substance listed in § 5-708 of this subtitle:\n(1) with the intent to induce unlawful inhaling of the substance; or\n(2) with the knowledge that the other will unlawfully inhale the substance.\n(c) A person may not:\n(1) instruct another in the practice of inhaling or smelling that is prohibited under § 5-708(b) of this subtitle; or\n(2) distribute a butane canister to a minor.\n(d) A person who violates this section is guilty of a misdemeanor and on conviction is subject to imprisonment not exceeding 18 months or a fine not exceeding $1,000 or both.","path":["Article - Criminal Law"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gcr\u0026section=5-709","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:57:08Z","sha256":"b36a4e416346d461b3c48f7269f3d8ff0e7645ca78f72cbb4255d1ccdbaa3478","source_id":"us-md","stale":false,"prev":"us-md/md.-code-criminal-law-5-708","next":"us-md/md.-code-criminal-law-5-710"},"notice":"GroundRules: Original legal text.
