Code, Criminal Law § 7–113","heading":"","body":"(a) A fiduciary may not:\n(1) fraudulently and willfully appropriate money or a thing of value that the fiduciary holds in a fiduciary capacity contrary to the requirements of the fiduciary’s trust responsibility; or\n(2) secrete money or a thing of value that the fiduciary holds in a fiduciary capacity with a fraudulent intent to use the money or thing of value contrary to the requirements of the fiduciary’s trust responsibility.\n(b) A person who violates this section is guilty of the misdemeanor of embezzlement and on conviction is subject to imprisonment for not less than 1 year and not exceeding 5 years.\n(c) A person who violates this section is subject to § 5-106(b) of the Courts Article.","path":["Article - Criminal Law"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gcr\u0026section=7-113","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:57:08Z","sha256":"1372fa85553d70033a51ad8117518f597baac02efd318063e3b638cfbf06de6f","source_id":"us-md","stale":false,"prev":"us-md/md.-code-criminal-law-7-110","next":"us-md/md.-code-criminal-law-7-114"},"notice":"GroundRules: Original legal text.
