Code, Criminal Law § 9–401","heading":"","body":"(a) In this subtitle the following words have the meanings indicated.\n(b) “Concealment” means hiding, secreting, or keeping out of sight.\n(c) “Escape” retains its judicially determined meaning.\n(d) “Fugitive” means an individual for whom a felony arrest warrant has been issued and is outstanding.\n(e) (1) “Harbor” includes offering a fugitive or escaped incarcerated individual:\n(i) concealment;\n(ii) lodging;\n(iii) care after concealment; or\n(iv) obstruction of an effort of an authority to arrest the fugitive or escaped incarcerated individual.\n(2) “Harbor” does not include failing to reveal the whereabouts of a fugitive or an escaped incarcerated individual by a person who did not participate in the effort of the fugitive or escaped incarcerated individual to elude arrest.\n(f) “Hardware secure facility” means a facility that is securely locked or fenced to prevent escape.\n(g) (1) “Place of confinement” means:\n(i) a correctional facility;\n(ii) a facility of the Maryland Department of Health; or\n(iii) any other facility in which a person is confined under color of law.\n(2) “Place of confinement” does not include:\n(i) a detention center for juveniles;\n(ii) a facility for juveniles listed in § 9–226(b) of the Human Services Article;\n(iii) a place identified in a juvenile community detention order; or\n(iv) a privately operated, hardware secure facility for juveniles committed to the Department of Juvenile Services.","path":["Article - Criminal Law"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gcr\u0026section=9-401","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:57:08Z","sha256":"f21323de8cc4fa9c5f09caf1e99fbf96070423b16b22b5291367ed8daa48d5f5","source_id":"us-md","stale":false,"prev":"us-md/md.-code-criminal-law-9-307","next":"us-md/md.-code-criminal-law-9-402"},"notice":"GroundRules: Original legal text.
