Code, Criminal Law § 9–408","heading":"","body":"(a) In this section, “police officer” means an individual who is authorized to make an arrest under Title 2 of the Criminal Procedure Article.\n(b) A person may not intentionally:\n(1) resist a lawful arrest; or\n(2) interfere with an individual who the person has reason to know is a police officer who is making or attempting to make a lawful arrest or detention of another person.\n(c) A person who violates this section is guilty of a misdemeanor and is subject to imprisonment not exceeding 3 years or a fine not exceeding $5,000 or both.\n(d) The unit of prosecution for a violation of this section is based on the arrest or detention regardless of the number of police officers involved in the arrest or detention.","path":["Article - Criminal Law"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gcr\u0026section=9-408","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:57:08Z","sha256":"47256d77a5373effc35fc3a448da6efd8adda8c562859ae905725193a15714f5","source_id":"us-md","stale":false,"prev":"us-md/md.-code-criminal-law-9-407","next":"us-md/md.-code-criminal-law-9-410"},"notice":"GroundRules: Original legal text.
