Code, Criminal Procedure § 10–306","heading":"","body":"(a) A person authorized to access a shielded record under § 10–302(b) of this subtitle may not disclose any information from a shielded record to a person who is not authorized to access shielded records under § 10–302(b) of this subtitle.\n(b) (1) Except as provided in § 10–302(b) of this subtitle, an employer may not:\n(i) require a person who applies for employment to disclose shielded information about criminal charges in an application, an interview, or otherwise; or\n(ii) discharge or refuse to hire a person solely because the person refused to disclose information about criminal charges that have been shielded.\n(2) An educational institution may not:\n(i) require a person who applies for admission to the institution to disclose shielded information about criminal charges in an application, an interview, or otherwise; or\n(ii) expel or refuse to admit a person solely because the person refused to disclose information about criminal charges that have been shielded.\n(3) Except as provided in § 10–302(b) of this subtitle, a unit, an official, or an employee of the State or a political subdivision of the State may not:\n(i) require a person who applies for a permit, registration, or government service to disclose shielded information about criminal charges in an application, an interview, or otherwise; or\n(ii) deny a person’s application for a permit, registration, or government service solely because the person refused to disclose information about criminal charges that have been shielded.","path":["Article - Criminal Procedure"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gcp\u0026section=10-306","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:57:17Z","sha256":"e6f9bb667f85b14da466db6e8c0857ac8e8ac3d6be74fd9fa371999e668e1163","source_id":"us-md","stale":false,"prev":"us-md/md.-code-criminal-procedure-10-305","next":"us-md/md.-code-criminal-procedure-10-401"},"notice":"GroundRules: Original legal text.
