Code, Criminal Procedure § 11–727","heading":"","body":"(a) Unless waived by the State’s Attorney and defense counsel, before sentencing a defendant who is required to register under § 11–704 of this subtitle for a violation of § 3–602 of the Criminal Law Article, the court shall order the defendant to submit to:\n(1) a presentence investigation conducted by the Division of Parole and Probation; and\n(2) a mental health assessment, including whether the defendant is a danger to self or others, conducted by a qualified mental health professional employed or engaged by the Maryland Department of Health.\n(b) The court shall consider the presentence investigation and mental health evaluation when sentencing the defendant.","path":["Article - Criminal Procedure"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gcp\u0026section=11-727","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:57:17Z","sha256":"27fb476285d86a0e82ff79b2f2995389f93f358dc7692882fcc23f0db1d96543","source_id":"us-md","stale":false,"prev":"us-md/md.-code-criminal-procedure-11-726","next":"us-md/md.-code-criminal-procedure-11-801"},"notice":"GroundRules: Original legal text.
