Code, Criminal Procedure § 12–207","heading":"","body":"(a) The forfeiting authority shall surrender the motor vehicle on request to the owner if the forfeiting authority determines, independent of the decision of the seizing authority, that:\n(1) the motor vehicle falls within the purview of § 12-205 of this subtitle; or\n(2) the standards listed under § 12-204(b) of this subtitle were not met.\n(b) In a proceeding under this title, the court may determine, based on the standards listed in § 12-204(b) of this subtitle, whether the seizing authority or forfeiting authority abused its discretion or was clearly erroneous:\n(1) in recommending the forfeiture of a motor vehicle; or\n(2) in not surrendering on request a motor vehicle to an owner.","path":["Article - Criminal Procedure"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gcp\u0026section=12-207","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:57:17Z","sha256":"339dbdfae8abf1d840bb7270bb166640ea1a5848ca6932dce35019055739f9f9","source_id":"us-md","stale":false,"prev":"us-md/md.-code-criminal-procedure-12-206","next":"us-md/md.-code-criminal-procedure-12-208"},"notice":"GroundRules: Original legal text.
