Code, Criminal Procedure § 15–109","heading":"","body":"(a) If necessary due to an absence, sickness, resignation, or death of a State’s Attorney, the circuit court for the county may appoint a competent individual to perform the duties of the State’s Attorney in conducting criminal or civil cases arising or pending in the circuit court until:\n(1) the State’s Attorney is able to attend and act in person; or\n(2) a new State’s Attorney is appointed and qualified.\n(b) An individual appointed under subsection (a) of this section shall receive the same compensation as the State’s Attorney who is replaced.","path":["Article - Criminal Procedure"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gcp\u0026section=15-109","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:57:17Z","sha256":"58370ff5eaf19fb975c2e4a37bd23c164002437baec7765c9fc1988b1d67d58f","source_id":"us-md","stale":false,"prev":"us-md/md.-code-criminal-procedure-15-108","next":"us-md/md.-code-criminal-procedure-15-201"},"notice":"GroundRules: Original legal text.
