Code, Criminal Procedure § 3–114","heading":"","body":"(a) A committed person may be released under the provisions of this section and §§ 3–115 through 3–122 of this title.\n(b) A committed person is eligible for discharge from commitment only if that person would not be a danger, as a result of a mental disorder or an intellectual disability, to self or to the person or property of others if discharged.\n(c) A committed person is eligible for conditional release from commitment only if that person would not be a danger, as a result of a mental disorder or an intellectual disability, to self or to the person or property of others if released from confinement with conditions imposed by the court.\n(d) To be released, a committed person has the burden to establish by a preponderance of the evidence eligibility for discharge or eligibility for conditional release.","path":["Article - Criminal Procedure"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gcp\u0026section=3-114","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:57:17Z","sha256":"e4bded4464743fdd513e4a73e58be3dc6528d7b1cb7e04c4633858ab6ccce39d","source_id":"us-md","stale":false,"prev":"us-md/md.-code-criminal-procedure-3-113","next":"us-md/md.-code-criminal-procedure-3-115"},"notice":"GroundRules: Original legal text.
