Code, Criminal Procedure § 5–103","heading":"","body":"(a) In this section, “pretrial risk scoring instrument” means a tool, a metric, an algorithm, or software that is used to assist in determining the eligibility of a defendant for pretrial release in a pretrial proceeding based on the defendant’s flight risk and threat to community safety.\n(b) A jurisdiction that uses a pretrial risk scoring instrument to determine the eligibility of a defendant for pretrial release shall have an independent validation study of the pretrial risk scoring instrument conducted at least once every 5 years.","path":["Article - Criminal Procedure"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gcp\u0026section=5-103","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:57:17Z","sha256":"1839b75f21ea84b2f44fcbd2e835fa9595ab59f4359f8b4b1662f6583fcb7891","source_id":"us-md","stale":false,"prev":"us-md/md.-code-criminal-procedure-5-102","next":"us-md/md.-code-criminal-procedure-5-104"},"notice":"GroundRules: Original legal text.
