Code, Economic Development § 5–2001","heading":"","body":"(a) In this subtitle the following words have the meanings indicated.\n(b) “Program” means the Winery and Vineyard Economic Development Grant Program established under § 5–2002 of this subtitle.\n(c) “Qualified capital expenses” means all expenditures made by an individual or a corporation for the purchase and installation of equipment or agricultural materials for use in the production of agricultural products at a vineyard or a winery, including:\n(1) barrels;\n(2) bins;\n(3) bottling equipment;\n(4) canopy management machines;\n(5) capsuling equipment;\n(6) chemicals;\n(7) corkers;\n(8) crushers;\n(9) destemmers;\n(10) fermenters or other recognized fermentation devices;\n(11) fertilizer and soil amendments;\n(12) filters;\n(13) fruit harvesters;\n(14) fruit plants;\n(15) hoses;\n(16) irrigation equipment;\n(17) labeling equipment;\n(18) lugs;\n(19) mowers;\n(20) poles;\n(21) posts;\n(22) presses;\n(23) pruning equipment;\n(24) pumps;\n(25) refractometers;\n(26) refrigeration equipment;\n(27) seeders;\n(28) soil;\n(29) small tools;\n(30) tanks;\n(31) tractors;\n(32) vats;\n(33) weeding and spraying equipment;\n(34) wine tanks;\n(35) wire; and\n(36) any other items as approved by the Department.\n(d) “Vineyard” means agricultural lands located in the State consisting of at least 1 contiguous acre dedicated to the growing of grapes that are used or are intended to be used in the production of wine by a winery as well as any plants or other improvements located on the agricultural lands.\n(e) “Winery” means an establishment or a location identified in:\n(1) a Class 3 winery license issued under § 2–205 of the Alcoholic Beverages and Cannabis Article; or\n(2) a Class 4 limited winery license issued under § 2–206 of the Alcoholic Beverages and Cannabis Article.","path":["Article - Economic Development"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gec\u0026section=5-2001","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:57:28Z","sha256":"43872f4d84a488d88c3f150c4c390c440f644a490fe950fb7b75591f7d3ed873","source_id":"us-md","stale":false,"prev":"us-md/md.-code-economic-development-5-1901","next":"us-md/md.-code-economic-development-5-2002"},"notice":"GroundRules: Original legal text.
