Code, Education § 23–102.2","heading":"","body":"(a) (1) In this section the following words have the meanings indicated.\n(2) “Automated external defibrillator (AED)” has the meaning stated in § 13–517 of this article.\n(3) (i) “Library” means:\n1. Each branch of a county library system; or\n2. The Enoch Pratt Free Library.\n(ii) “Library” does not include:\n1. A school library established by a local school system;\n2. A mobile library unit; or\n3. A correctional facility library.\n(b) Beginning January 1, 2026, each library shall:\n(1) Place an automated external defibrillator in a prominent area, accessible to employees and library users;\n(2) Comply with § 13–517 of this article; and\n(3) Maintain the functionality of the automated external defibrillator.\n(c) In addition to any other immunities available under statutory or common law:\n(1) A library is not civilly liable for any act or omission in the provision of automated external defibrillation if the library has satisfied the requirements under this section;\n(2) An individual is not civilly liable for any act or omission if:\n(i) The individual is acting in good faith while rendering automated external defibrillation to another individual who is the victim or is reasonably believed by the individual to be a victim of a sudden cardiac arrest;\n(ii) The assistance or aid is provided in a reasonably prudent manner; and\n(iii) The automated external defibrillation is provided without fee or other compensation; and\n(3) A library or individual is not civilly liable for failing to render automated external defibrillation to an individual who is a victim or is reasonably believed to be a victim of a sudden cardiac arrest.","path":["Article - Education"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=ged\u0026section=23-102.2","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:57:38Z","sha256":"b383febb0a61331b236e1bdceed907b1383f5512334eeb79a3126e809a4302a7","source_id":"us-md","stale":false,"prev":"us-md/md.-code-education-23-102.1","next":"us-md/md.-code-education-23-103"},"notice":"GroundRules: Original legal text.
