Code, Education § 23–108","heading":"","body":"(a) Subject to the provisions of subsection (b) of this section, a public, school, college, or university library in this State shall prohibit inspection, use, or disclosure of any circulation record or other item, collection, or grouping of information about an individual that:\n(1) Is maintained by a library;\n(2) Contains an individual’s name or the identifying number, symbol, or other identifying particular assigned to the individual; and\n(3) Identifies the use a patron makes of that library’s materials, services, or facilities.\n(b) A public, school, college, or university library in the State shall permit inspection, use, or disclosure of the circulation record of an individual only:\n(1) If necessary for the reasonable operation of the library;\n(2) On written consent of the individual; or\n(3) By subpoena or court order.","path":["Article - Education"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=ged\u0026section=23-108","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:57:38Z","sha256":"ea29d76b216211286b239ddd3f6790d2ab132da12729aad6f9142529becf2bc1","source_id":"us-md","stale":false,"prev":"us-md/md.-code-education-23-107","next":"us-md/md.-code-education-23-109"},"notice":"GroundRules: Original legal text.
