Code, Education § 6–904","heading":"","body":"(a) (1) Any public school employee who is subject to a personnel action in violation of § 6–902 of this subtitle may file an administrative complaint with a public school employer.\n(2) A public school employer shall:\n(i) Provide an administrative remedial process for a public school employee who files an administrative complaint under paragraph (1) of this subsection; and\n(ii) Complete the administrative remedial process under item (i) of this paragraph within 30 days after a public school employee files an initial administrative complaint.\n(b) (1) Before instituting a civil action, a public school employee who is subject to a personnel action in violation of § 6–902 of this subtitle shall notify the local superintendent in writing of the employee’s intention to institute a civil action.\n(2) Subject to paragraph (1) of this subsection, any public school employee who is subject to a personnel action in violation of § 6–902 of this subtitle may institute a civil action in the county where:\n(i) The alleged violation occurred;\n(ii) The employee resides; or\n(iii) The public school employer maintains its principal offices in the State.\n(3) The action shall be brought within 9 months after the alleged violation of § 6–902 of this subtitle occurred, or within 9 months after the public school employee first became aware of the alleged violation of § 6–902 of this subtitle.","path":["Article - Education"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=ged\u0026section=6-904","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:57:38Z","sha256":"3f8a039722c7180f1c999cbec11b87cfeb3447553bbce76fd58fefea0ef45bd4","source_id":"us-md","stale":false,"prev":"us-md/md.-code-education-6-903","next":"us-md/md.-code-education-6-905"},"notice":"GroundRules: Original legal text.
