Code, Environment § 12–310","heading":"","body":"(a) Except as provided in this section for an action under § 12-308 of this subtitle, any person aggrieved by a final decision of the Board in a contested case, as defined in the Administrative Procedure Act, may:\n(1) Appeal the decision to the Board of Review; and\n(2) Then take any further appeal allowed by the Administrative Procedure Act.\n(b) (1) Any person aggrieved by a final decision of the Board under § 12-308 of this subtitle may not appeal to the Secretary or Board of Review but may take a direct judicial appeal.\n(2) The appeal shall be made as provided for judicial review of final decisions in the Administrative Procedure Act.","path":["Article - Environment"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gen\u0026section=12-310","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:57:58Z","sha256":"47a09ee7ce76dbd1c8bb1f184d41dac2efc8d02bbee218edba6c9c2abb8e44e9","source_id":"us-md","stale":false,"prev":"us-md/md.-code-environment-12-309","next":"us-md/md.-code-environment-12-401"},"notice":"GroundRules: Original legal text.
