Code, Environment § 4–109","heading":"","body":"(a) The Department may issue a written complaint if the Department has reasonable grounds to believe that the person to whom the complaint is directed has violated:\n(1) This subtitle;\n(2) Any rule or regulation adopted under this subtitle; or\n(3) Any sediment control plan approved under this subtitle.\n(b) After or concurrently with service of a complaint under this subtitle, the Department may:\n(1) Issue an order that requires the person to whom the order is directed to take corrective action within a time set in the order;\n(2) Send a written notice that requires the person to whom the notice is directed to file a written report about the alleged violation; or\n(3) Send a written notice that requires the person to whom the notice is directed:\n(i) To appear at a hearing before the Department at a time and place the Department sets to answer the charges in the complaint; or\n(ii) To file a written report and also appear at a hearing before the Department at a time and place the Department sets to answer the charges in the complaint.\n(c) Any order issued under this section is effective immediately, according to its terms, when it is served.","path":["Article - Environment"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gen\u0026section=4-109","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:57:58Z","sha256":"ba6dd7db68c6fe2b7004e6faefc300ae672d028d0bc5d0bc12a49d4f6e28f4bc","source_id":"us-md","stale":false,"prev":"us-md/md.-code-environment-4-108","next":"us-md/md.-code-environment-4-110"},"notice":"GroundRules: Original legal text.
