Code, Environment § 4–114","heading":"","body":"(a) Except as provided in subsection (b) of this section, before the Department exercises its authority under § 4-109 or § 4-110 of this subtitle, the Department shall:\n(1) Notify the delegated county or municipality of the violation and the Department’s intended action; and\n(2) Provide reasonable opportunity for a joint inspection with a representative of the delegated county or municipality.\n(b) If the Department determines that there is a substantial threat to the environment, the Department may take appropriate enforcement action without first providing a reasonable opportunity for a joint inspection under subsection (a)(2) of this section.","path":["Article - Environment"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gen\u0026section=4-114","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:57:58Z","sha256":"c522535280a61b8e104d653834c755ade88b2e30d1e865ac1d8625beaec7624f","source_id":"us-md","stale":false,"prev":"us-md/md.-code-environment-4-113","next":"us-md/md.-code-environment-4-115"},"notice":"GroundRules: Original legal text.
