Code, Environment § 4–211","heading":"","body":"(a) The Department shall give notice and hold any hearing under this subtitle in accordance with the Administrative Procedure Act.\n(b) Within 10 days after being served with an order under § 4–209(a)(1) of this subtitle or a notice under § 4–209(a)(2) of this subtitle, the person served may request in writing a hearing before the Department.\n(c) The Department may make a verbatim record of the proceedings of any hearing held under this subtitle.\n(d) (1) In connection with any hearing under this subtitle, the Department may:\n(i) Subpoena any person or evidence; and\n(ii) Order a witness to give evidence.\n(2) A subpoenaed witness shall receive the same fees and mileage reimbursement as if the hearing were part of a civil action.\n(3) If a person fails to comply with a subpoena or order issued under this subsection, on petition of the Department, a circuit court, by order, may:\n(i) Compel obedience to the Department’s order or subpoena; or\n(ii) Compel testimony or the production of evidence.\n(4) The court may punish as a contempt any failure to obey its order issued under this section.","path":["Article - Environment"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gen\u0026section=4-211","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:57:58Z","sha256":"f4ee16e4db631fb544dd9474234da048c2ced49b05bb37b427e17e595c3aa412","source_id":"us-md","stale":false,"prev":"us-md/md.-code-environment-4-210","next":"us-md/md.-code-environment-4-212"},"notice":"GroundRules: Original legal text.
