Code, Environment § 4–415.1","heading":"","body":"(a) At any reasonable time, to carry out duties under this subtitle, a representative of the Department may enter any oil storage facility or vessel or barge in or entering upon the waters of the State to discharge or receive a cargo of any bulk oil:\n(1) To inspect the vessel, barge, or oil storage facility;\n(2) To obtain water, air, or soil samples; and\n(3) To measure the volume and kinds of substances that are received or stored.\n(b) The Department may enter any property and assume control of any oil spill situation when it determines that a responsible party is not:\n(1) Acting promptly to remove the spill; or\n(2) Undertaking removal or mitigation in a manner appropriate to control or rectify the conditions causing the condition.\n(c) If entry is denied under this section, the Secretary may seek an injunction to enter the facility or property.","path":["Article - Environment"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gen\u0026section=4-415.1","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:57:58Z","sha256":"903f84f8fc29aca32800ae48d58c90cb9a52efc42fb924d0d25318873f5f9339","source_id":"us-md","stale":false,"prev":"us-md/md.-code-environment-4-415","next":"us-md/md.-code-environment-4-416"},"notice":"GroundRules: Original legal text.
