Code, Environment § 4–801","heading":"","body":"(a) In this subtitle the following words have the meanings indicated.\n(b) “Compliance assistance” means an action taken by a jurisdiction with delegated authority under Subtitle 1 of this title that:\n(1) Corrects a violation before a formal enforcement action is necessary; or\n(2) Was voluntarily taken to prevent future violations.\n(c) “Critical Area” has the meaning stated in § 8–1802 of the Natural Resources Article.\n(d) (1) “Sensitive area” means an area of critical concern.\n(2) “Sensitive area” includes:\n(i) Buffers, as defined in COMAR 27.01.01.01;\n(ii) Habitat protection areas, as defined in COMAR 27.01.01.01;\n(iii) Modified buffer areas, as defined in COMAR 27.01.01.01;\n(iv) Nontidal wetlands, as defined in COMAR 26.23.01.01;\n(v) Tidal wetlands, as defined in COMAR 26.24.01.02;\n(vi) 100–year floodplains, as defined in COMAR 08.19.03.01; and\n(vii) Stream buffers, as defined in COMAR 08.19.03.01.","path":["Article - Environment"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gen\u0026section=4-801","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:57:58Z","sha256":"ed94d5e937e3a40a537900fdd6a56229620c1cac0c4b9b304b59397a10181b1d","source_id":"us-md","stale":false,"prev":"us-md/md.-code-environment-4-708","next":"us-md/md.-code-environment-4-802"},"notice":"GroundRules: Original legal text.
