Code, Environment § 5–203.2","heading":"","body":"(a) In this section, “dam safety permit” means a permit issued under § 5–503 of this title for the construction, reconstruction, repair, removal, or modification of a dam.\n(b) This section does not apply to a reservoir, dam, waterway obstruction, or small pond that is exempt from permit requirements under § 5–503(b) of this title.\n(c) The application for a dam safety permit shall include the estimated project construction cost.\n(d) Prior to the issuance of a dam safety permit, the Department shall collect a dam safety permit fee.\n(e) The dam safety permit fee:\n(1) Shall be based on the estimated project construction cost; and\n(2) May not exceed 3% of the estimated project construction cost.\n(f) Fees collected under this section shall be paid into the Private Dam Repair Fund established under § 5–509.2 of this title.","path":["Article - Environment"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gen\u0026section=5-203.2","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:57:58Z","sha256":"fb282d0a3b9b6d814aa874075fec2fe4c6bebd70276560b351d926e6ae43b56f","source_id":"us-md","stale":false,"prev":"us-md/md.-code-environment-5-203.1","next":"us-md/md.-code-environment-5-204"},"notice":"GroundRules: Original legal text.
