Code, Environment § 7–242","heading":"","body":"(a) As a requirement for keeping the facility permit, each facility permit holder shall:\n(1) Maintain a bond or other security that the Department considers sufficient to cover any cost for:\n(i) Guaranteeing fulfillment of all requirements related to the facility permit;\n(ii) Monitoring, maintaining, or closing the controlled hazardous substance facility; and\n(iii) Assuring the security of the controlled hazardous substance facility after closing;\n(2) Design, construct, and operate the controlled hazardous substance facility in the manner approved by the Department;\n(3) Establish emergency procedures and safeguards to prevent accidents and reasonably foreseeable harm to human beings or the environment;\n(4) Report periodically on the controlled hazardous substance that is received and discharged by the controlled hazardous substance facility, including, as applicable, volume, and chemical, physical, biological, and radioactive nature;\n(5) In appropriate circumstances, assist in any transfer of the ownership and operation of a controlled hazardous substance facility to a qualified agency of this State or any political subdivision of this State; and\n(6) To the extent reasonably practicable, restore the controlled hazardous substance facility site to its original condition if use as a controlled hazardous substance facility is terminated.\n(b) In addition to the requirements for keeping a facility permit under subsection (a) of this section, each low-level nuclear waste facility permit holder shall:\n(1) Ensure that any low-level nuclear waste being shipped to the low-level nuclear waste facility is labeled and transported in accordance with this subtitle;\n(2) Refuse to accept for disposal any low-level nuclear waste that has not been labeled or transported in accordance with this subtitle; and\n(3) Comply with any other requirements the Department sets.","path":["Article - Environment"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gen\u0026section=7-242","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:57:58Z","sha256":"ad6cea80314d7f3b36fab8240d99b12ffd5a609be669d64215c134b1da4f5ac1","source_id":"us-md","stale":false,"prev":"us-md/md.-code-environment-7-241","next":"us-md/md.-code-environment-7-243"},"notice":"GroundRules: Original legal text.
