Code, Environment § 9–1713","heading":"","body":"(a) (1) In this section, “recycling facility” means a facility that provides recycling services.\n(2) “Recycling facility” does not include:\n(i) A composting facility;\n(ii) A facility that requires a natural wood waste recycling facility permit in accordance with this subtitle;\n(iii) A facility that requires a sewage sludge utilization permit in accordance with Subtitle 2 of this title; or\n(iv) A facility that serves as a drop–off and collection point for residential recyclable materials.\n(b) The Department shall adopt regulations to:\n(1) Establish conditions under which a recycling facility does not require a refuse disposal permit under Subtitle 2 of this title; and\n(2) Exempt certain materials that are managed at a recycling facility from being designated as solid waste.\n(c) The regulations adopted under subsection (b) of this section may include:\n(1) Design, construction, and operational conditions for recycling facilities to protect public health and the environment and minimize nuisances;\n(2) A tiered system of permits or approvals for recycling facilities based on the material managed, the methods of management and storage, and other factors determined by the Department to be appropriate; and\n(3) Exceptions to any requirement to obtain a recycling facility permit or approval.\n(d) Sections 9–334 through 9–342 of this title and § 10–104 of this article apply to violations of:\n(1) This section;\n(2) Any regulation adopted under this section; or\n(3) Any order or permit issued under this section.","path":["Article - Environment"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gen\u0026section=9-1713","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:57:58Z","sha256":"c9db97831bac675cf2820b65ace9b1f97107893d2fa6f7228db3663bdf997ed5","source_id":"us-md","stale":false,"prev":"us-md/md.-code-environment-9-1712","next":"us-md/md.-code-environment-9-1714"},"notice":"GroundRules: Original legal text.
